General Terms and Conditions Stichting Webshop Keurmerk

These General Terms and Conditions of Stichting Webshop Keurmerk have been drawn up in consultation with the Consumers' Association within the framework of the Coordination Group Self-Regulatory Consultation (CZ) of the Social and Economic Council and come into effect on 1 June 2014. These General Terms and Conditions will be used by all members of the Stichting Webshop Keurmerk, with the exception of financial services as referred to in the Financial Supervision Act and insofar as these services are supervised by the Netherlands Authority for the Financial Markets.

Article 01 - Definitions

In these terms and conditions shall apply:

Supplementary agreement

An agreement whereby the consumer productenacquires digital content and/or services in connection with a distance contract and these items, digital content and/or services are supplied by the entrepreneur or by a third party on the basis of an agreement between that third party and the entrepreneur;

Reflection time

The term within which the consumer can make use of his right of withdrawal;

Consumer

The natural person who is not acting for purposes related to his trade, business, craft or profession;

Day

Calendar day;

Digital Content

data produced and delivered in digital form;

Consultancy Agreement

An agreement that extends to the regular delivery of goods, services and/or digital content during a certain period;

Durable medium

Any tool - including e-mail - that enables the consumer or entrepreneur to store information that is addressed to him personally in a way that facilitates future consultation or use during a period that is tailored to the purpose for which the information is intended, and which allows unaltered reproduction of the stored information;

Right of Withdrawal

The possibility for the consumer to waive the distance contract within the cooling-off period;

Entrepreneur

The natural or legal person who is a member of Stichting Webshop Keurmerk and producten, offers (access to) digital content and/or services remotely to consumers;

Distance contract

An agreement concluded between the entrepreneur and the consumer in the context of an organized system for distance selling producten, digital content and/or services, where one or more techniques for distance communication are used exclusively or partly up to and including the conclusion of the agreement;

Model withdrawal form

The European model withdrawal form included in Annex I of these terms and conditions;

Technology for distance communication

Resource that can be used to conclude an agreement, without the consumer and entrepreneur having to be in the same room at the same time;

If the activity of the entrepreneur is subject to a relevant licensing system: the details of the supervisory authority;

Article 03 - Applicability

  • These general conditions apply to every offer of the entrepreneur and any agreement reached at a distance between businesses and consumers.
  • Before the remote agreement is concluded, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, the entrepreneur shall, before the contract is concluded remotely, indicate the manner in which the terms and conditions of the entrepreneur are identified and that they are sent free of charge at the request of the consumer as soon as possible.
  • If the distance contract is concluded electronically, notwithstanding the preceding paragraph and before the distance contract is concluded, the text of these terms and conditions are set in such a way that the consumer in the consumer made available electronically a simple way can be stored on a durable medium. Article 04 - The offer

  • If an offer is of limited duration or subject to conditions, this will be explicitly stated in the offer.

Article 05 - The contract

  • The agreement is subject to the provisions of paragraph 4, established at the time the consumer accepts the offer and meet the corresponding conditions.
  • If the consumer has accepted the offer by electronic means, the entrepreneur immediately confirms receipt of acceptance of the offer by electronic means. As long as the acceptance of this acceptance has not been confirmed by the entrepreneur, the consumer can terminate the agreement.

    • The price, including all taxes on the product, service or digital content; insofar as applicable, the costs of delivery; and the method of payment, delivery or implementation of the distance contract;
    • The requirements for terminating the agreement if the agreement has a duration of more than one year or is indefinite;
    • If the consumer has a right of withdrawal, the model withdrawal form.
  • In the event of an overdraft transaction, the provision in the previous paragraph applies only to the first delivery.

Article 06 - Right of withdrawal

At producten:

  • The consumer can terminate an agreement regarding the purchase of a product during a cooling-off period of 14 days without giving reasons. The entrepreneur may ask the consumer about the reason for withdrawal, but not oblige him to state his reason (s).
  • The term referred to in paragraph 1 shall commence on the day after the consumer, or a third party designated by the consumer, who is not the carrier, received the product, or:

Article 07 - Obligations of the consumer during the reflection

  • During the bedtime, the consumer will carefully handle the product and the packaging. He will only extract or use the product to the extent necessary to determine the nature, characteristics and operation of the product.   • The consumer is solely responsible for impairment of the product resulting from a way of dealing with the product beyond that permitted by paragraph 1.
  • The consumer is not liable for impairment of the product if the entrepreneur has not provided him with all statutory mandatory information on the right of withdrawal before or upon the conclusion of the agreement.
  • In case dIf the consumer receives a product with a defect/defect, he must notify the entrepreneur of this within 48 hours of receipt by email, including images. After assessment, the consumer will receive a return label from the entrepreneur if the defect cannot be attributed to the consumer. In the event that the consumer decides to return the article at his own expense, these return costs will not be reimbursed by the entrepreneur.

Article 08 - Exercise of the right of withdrawal by the consumer and cost of

  • If the consumer makes use of his right of withdrawal, he will notify the entrepreneur within the cooling-off period by means of the model withdrawal form or otherwise unambiguously.
  • As soon as possible, but within 14 days from the day following the notification referred to in paragraph 1, the consumer sends the product back, or hands it over to (an authorized representative) of the entrepreneur. This does not have to be taken if the entrepreneur has offered the product itself.   • The consumer will return the product with all delivered accessories, if reasonably possible in original condition and packaging, and in accordance with the reasonable and clear instructions provided by the entrepreneur.
  • The risk and burden of proof for the right and timely exercise of the right of withdrawal lies with the consumer.
  • The consumer bears the direct costs of returning the product and not the entrepreneur.
If the consumer makes use of his right of withdrawal, all additional agreements are terminated by law.

Article 09 - Obligations of the trader in case of withdrawal

  • If the vendor makes the notification possible by electronic means, the vendor will send a receipt of receipt immediately upon receipt of this notification.
  • The trader will reimburse all payments from the consumer, including any delivery costs charged by the trader for the returned product, immediately but within 14 days following the day on which the consumer notifies him of the withdrawal. Unless the entrepreneur offers to collect the product himself, he may wait to pay back until he has received the product or until the consumer demonstrates that he has returned the product, whichever comes first.
  • The entrepreneur uses the same means of payment used by the consumer for repayment unless the consumer agrees with another method. The refund is free for the consumer.
  • If the consumer has opted for a more expensive method of delivery than the cheapest standard delivery, the entrepreneur does not have to reimburse the additional costs for the more expensive method.

Article 10 - Exclusion of right of withdrawal

  • Producten or services whose price is subject to fluctuations in the financial market over which the entrepreneur has no influence and which may occur within the withdrawal period

  • The performance has started with the explicit prior consent of the consumer; and
  • The consumer has stated that he thereby loses his right of withdrawal.

Article 11 - Price

  • During the period of validity stated in the offer, the prices of the offered producten and/or services will not be increased, except for price changes as a result of changes in VAT rates.
  • Notwithstanding the previous paragraph, the entrepreneur can: producten or offer services whose prices are subject to fluctuations in the financial market and over which the entrepreneur has no influence, with variable prices. This liability to fluctuations and the fact that any prices stated are target prices are stated in the offer.
  • Price increases within 3 months after the conclusion of the contract are only allowed if they result from legislation or regulations.

Article 12 - Compliance agreement and extended warranty

  • The entrepreneur guarantees that the producten and/or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of reliability and/or usability and the legal provisions and/or government regulations existing on the date of the conclusion of the agreement. If agreed, the entrepreneur also guarantees that the product is suitable for other than normal use.
  • A supplementary guarantee provided by the entrepreneur, its supplier, manufacturer or importer never limits the legal rights and claims that the consumer may under the agreement apply to the entrepreneur if the entrepreneur is flawed in compliance with his part of the agreement.
  • Supplementary Warranty is understood to mean any commitment of the entrepreneur, its supplier, importer or producer in which it grants to the consumer certain rights or claims that go beyond what is legally obligatory in the event of failure to comply with his part of the agreement .

Article 13 - Delivery and implementation

  • The entrepeneur will take the greatest possible care when receiving and implementing orders for products and when assessing applications for the provision of services.
  • The place of delivery is the address that the consumer has notified to the entrepreneur.
  • Subject to the provisions of Article 4 of these Terms and Conditions, the Entrepreneur will execute accepted orders at an expeditious speed, but not later than 30 days, unless another delivery date has been agreed. If delivery is delayed or if an order can not be executed or only partially, the consumer will receive it by 30 days after placing the order. In that case, the consumer has the right to dissolve the agreement without charge and the right to any compensation.
  • After dissolution in accordance with the previous paragraph, the entrepreneur will refund the amount paid by the consumer without delay.
  • The risk of damage and/or loss of producten rests with the entrepreneur until the moment of delivery to the consumer or a representative designated in advance and made known to the entrepreneur, unless expressly agreed otherwise.

Article 14 - Duration Trades: duration, termination and renewal

Termination:

  • The consumer can enter into an agreement for an indefinite period and which extends to the regular delivery of goods producten (including electricity) or services, at any time, taking into account the agreed cancellation rules and a notice period of no more than one month.
  • The consumer can enter into an agreement that has been entered into for a fixed period and which extends to the regular delivery of goods producten (including electricity) or services, at any time towards the end of the fixed term, taking into account the agreed cancellation rules and a notice period of no more than one month.
  • The consumer can agree the agreements mentioned in the previous paragraphs:
    • Cancel at any time and not be limited to cancellation at a specific time or in a specific period;

Extension:

  • An agreement that has been entered into for a fixed period and that extends to the regular delivery of producten (including electricity) or services, may not be tacitly extended or renewed for a specific period.
  • By way of derogation from the previous paragraph, a fixed-term agreement which provides for the regular delivery of daily newspapers and magazines and magazines may be tacitly extended for a period of up to three months if the consumer agrees to this extended agreement terminate the end of the renewal with a notice period of no more than one month.
  • An agreement that has been entered into for a specific period and that extends to the regular delivery of producten or services, may only be tacitly extended for an indefinite period if the consumer may cancel at any time with a notice period of no more than one month. Duration:

  • If an agreement has a duration of more than one year, the consumer may terminate the agreement at any time with a notice period of no more than one month, unless the reasonableness and fairness oppose cancellation before the end of the agreed term.

Article 15 - Payment

  • Unless otherwise specified in the agreement or additional terms, the amounts owed by the consumer must be paid within 14 days after commencement of the business term, or in the absence of a notice within 14 days after the conclusion of the agreement. In the case of an agreement to provide a service, this term will commence on the day after the consumer has received the confirmation of the agreement.

Article 16 - Complaints

Article 17 - Disputes

  • Contracts between the entrepreneur and the consumer covered by these terms and conditions shall be governed by Dutch law.

Article 18 - Branch guarantee

This guarantee is revived if the binding advice has been upheld after a court review and the judgment proving this has become final. Up to an amount of € 10.000 per binding advice, this amount will be paid to the consumer by Stichting Webshop Keurmerk. For amounts greater than € 10.000 per binding advice, € 10.000 will be paid.   • Application of this guarantee requires that the consumer makes a written appeal to Stichting Webshop Keurmerk and that he transfers his claim against the entrepreneur to Stichting Webshop Keurmerk. If the claim against the entrepreneur amounts to more than € 10.000, the consumer is offered to transfer his claim to the extent that it exceeds the amount of € 10.000 to Stichting Webshop Keurmerk, after which this organization will make the payment in its own name and costs. will ask for this in court to satisfy the consumer.

Article 19 - Additional or different terms

Warranty on clothing:

Article 20 - Amendments to the general terms and conditions of Stichting Webshop Keurmerk

  • Stichting Webshop Keurmerk will not change these general terms and conditions unless in consultation with the Consumers' Association.
  • Changes to these terms and conditions are only effective after they have been published in the appropriate manner, on the understanding that in the event of applicable changes during the term of an offer, the provision that is most favorable to the consumer will prevail.
